This document explains privacy practices and certain customer-facing policies for Tutti Frutti Cafe and, as applicable, the related brands presented through or operated with Tutti Frutti Cafe, including Tutti Frutti, PIO Coffee, O’My, and TF Bites (collectively, the “Brands,” “we,” “us,” or “our”). It applies to TuttiFruttiCafe.com, online ordering and digital interactions, and, where expressly stated, visits to our physical locations. Some third-party ordering, delivery, payment, loyalty, social-media, or other services have their own privacy policies and terms.
PART I – PRIVACY POLICY
1. Information We May Collect
Information you provide. We may collect information you voluntarily provide, including name, email address, telephone number, delivery or billing address, account information, order details, loyalty or promotion information, customer-service communications, feedback, and other information you choose to provide.
Payment information. Payment information may be collected and processed by payment processors or ordering platforms. We generally do not need to retain complete payment-card numbers on our own systems.
Website and device information. When you use our website or digital services, we and our service providers may automatically collect technical and usage information such as IP address, browser or device information, pages viewed, referring pages, approximate location derived from IP address, interaction data, and cookie or similar identifiers.
Images and video at physical locations. For safety, security, loss prevention, incident review, and operational purposes, our locations may use visible security cameras that record video in public or customer-accessible areas. Cameras are not intended for areas where a person would reasonably expect privacy. Security footage may incidentally include a customer’s image. Audio recording, if any, will be used only as permitted by applicable law and applicable notice or consent requirements.
Photographs or recordings for business use. From time to time, we may photograph or record our premises, products, events, or general activity. A customer may appear incidentally in the background. For planned promotional content that focuses on an identifiable individual, we intend to obtain appropriate permission when required by law. Customers who have a concern about an image published by us may contact management for review.
Information from third parties. We may receive information from service providers and business partners that assist with ordering, delivery, payments, loyalty, analytics, advertising, communications, website hosting, fraud prevention, or related services.
2. How We May Use Information
We may use personal information to process and fulfill orders; provide pickup or delivery; communicate about orders or customer requests; operate, maintain, secure, and improve our services; administer loyalty programs, promotions, or offers; understand service usage; support safety and security; investigate incidents; prevent fraud or misuse; comply with legal obligations; establish, exercise, or defend legal claims; and, where permitted by law, provide marketing or advertising.

We do not sell personal information for money in the ordinary sense of the word “sell.” Some analytics or advertising technologies, however, may be treated as a sale or sharing under certain privacy laws even when no money is exchanged. Our services may link to or integrate with third-party websites, ordering platforms, delivery providers, payment processors, social networks, or other services. Their privacy practices are governed by their own policies, and we are not responsible for third parties we do not control. Customers and other visitors may independently take and post photographs or videos to social media. Unless acting on our behalf, those individuals are responsible for their own conduct and postings; we do not control or authorize independent customer postings merely because they occur at our premises.
10. Children’s Privacy
Our website and online services are intended for a general audience and are not directed to children under 13. We do not knowingly collect personal information online from children under 13 in a manner subject to the Children’s Online Privacy Protection Act without required parental consent. If we learn that such information was collected inappropriately, we will take reasonable steps to address it.
11. California Privacy Disclosures
If the California Consumer Privacy Act, as amended, applies to our business, California residents may have the rights described above. Categories of personal information we may collect can include identifiers; customer-record information; commercial information; internet or electronic-network activity; approximate geolocation; images, video, audio, electronic, or similar information where applicable; professional or employment-related information voluntarily submitted in an employment inquiry; and inferences drawn from other information where applicable. Sources may include you directly, automated collection, our physical premises, and service providers or business partners. We use and disclose these categories for the purposes described in this policy.
Where required, we will provide a notice at or before collection and any required “Do Not Sell or Share My Personal Information” or other privacy-choice mechanism. This policy does not replace a separate point-of-collection notice where one is legally required.
12. Changes to the Privacy Policy

13. Trademarks, Brand Names, and Intellectual Property
Tutti Frutti Cafe, Tutti Frutti, PIO Coffee, O’My, TF Bites, and associated names, logos, designs, trade dress, menu names, graphics, photographs, content, and other brand materials may be trademarks, service marks, copyrighted works, or other intellectual property owned by or licensed to us or related entities. Nothing on our website or at our locations grants a license or right to use our intellectual property for commercial purposes without prior written permission, except as permitted by law.
Customers may ordinarily take and share personal, non-commercial photographs of their purchases or visits, subject to reasonable store rules, the privacy and rights of other persons, safety requirements, and applicable law. Our trademarks or copyrighted materials may not be used in a manner that falsely suggests sponsorship, affiliation, endorsement, or authorization, or for unauthorized commercial merchandising or advertising.
14. Product Images, Portions, Weights, and Presentation
Our products are prepared, assembled, portioned, or served by people and may vary in appearance, placement, dimensions, volume, or weight from photographs, illustrations, samples, or prior orders. Product photographs are illustrative unless expressly stated otherwise. Where an item is sold by a stated weight, quantity, or measure, we intend to comply with applicable weights-and-measures requirements; this notice is not intended to waive or reduce any legally required quantity, measurement, labeling, or consumer right.
Reasonable variations can also result from cooking, melting, settling, aeration, moisture, ingredient shape, customer-selected toppings, substitutions, or preparation. Menu descriptions and images should not be interpreted as guarantees of exact visual appearance unless a specific characteristic is expressly promised.
15. Ingredients, Allergens, Nutrition, and Supplier Information
We prepare and serve products using ingredients obtained from manufacturers, distributors, and other suppliers. Ingredient, nutrition, allergen, dietary, and product information may be based in whole or in part on information supplied by those third parties and may change when suppliers, formulations, substitutions, or availability change. We endeavor to communicate information accurately, but customers with allergies, sensitivities, dietary restrictions, or ingredient concerns should tell our staff before ordering and should not rely solely on photographs, product names, marketing descriptions, or prior purchases.
Our kitchens, preparation areas, equipment, utensils, storage areas, and supplier facilities may handle multiple ingredients and allergens. Unless we specifically state otherwise for a particular product and can support that statement, we do not represent that any product is completely free from a particular allergen or that cross-contact cannot occur.
Nutrition or ingredient information supplied by manufacturers or other third parties is provided for informational purposes and should be understood in that context. Nothing on our website, menu, signage, packaging, social media, or in ordinary customer communications is intended as medical advice or as a representation that a food or beverage will diagnose, treat, cure, prevent, or manage diabetes, heart disease, mental-health conditions, allergies, or any other disease or medical condition. Customer safety and product quality are important to us. A customer who believes a product is incorrect, defective, contaminated, associated with an allergic reaction, or otherwise caused a safety concern should stop consuming the product, seek appropriate medical attention when needed, preserve relevant packaging or order information when practical, and promptly contact store management so the matter can be reviewed. We may request reasonable information necessary to investigate the complaint, identify the product or batch, communicate with suppliers, insurers, health authorities, or other appropriate parties, and take corrective action where warranted.
Where appropriate, we may offer a replacement, refund, or other customer-service resolution. Such a voluntary customer-service remedy does not limit any right or remedy that cannot lawfully be limited, and this policy does not attempt to disclaim responsibility that applicable law does not permit us to disclaim.
17. Safety, Conduct, and Right to Refuse or Discontinue Service
We want our locations to be safe and welcoming. We may refuse or discontinue service, ask a person to leave, or contact appropriate authorities when reasonably necessary to address violence, threats, harassment, unlawful conduct, significant disruption, property damage, interference with operations, or a reasonable health or safety concern. We endeavor to keep website, menu, pricing, availability, hours, ingredient, and promotional information current, but information may change and errors may occur. Products, prices, promotions, ingredients, and availability may vary by location or ordering channel. We may correct errors and update information subject to applicable law. Third-party ordering and delivery services may display information or impose fees, terms, or service conditions that they control.

Before publication, management should insert a monitored privacy/customer-service email address, mailing address, and any additional privacy-request method required by applicable law.
21. General Legal Statement
These notices are intended to communicate our practices and customer policies, not to eliminate obligations imposed by law. Nothing in this document waives rights or remedies that cannot legally be waived, limits duties imposed by food-safety, consumer-protection, disability-access, privacy, or other applicable laws, or creates a warranty or contractual right beyond what applicable law or a separate written agreement requires.
